2. The service
Fruitspan is an online subscription service that gives you access to summaries and analysis of South African fresh fruit export volumes: an interactive dashboard, season comparisons, market breakdowns, printable reports and data downloads. The figures are compiled from industry export statistics and are generally updated weekly.
We take care to process the data accurately, but it is provided as received from its sources. We don't guarantee that it is complete or error-free, and figures may be revised when the source data changes. The service gives information only; it is not financial, trading or investment advice, and decisions you make using it are your own.
You must be 18 or older, or acting for a business, to subscribe. Your account is for one named person; please don't share your login. An account can be signed in on up to 2 devices at a time (for example a computer and a phone). Signing in on another device signs out the device used longest ago. For several people, use a team plan.
3. Delivery policy
Fruitspan is a digital service. Nothing is posted or physically delivered.
- Free trial: access starts as soon as you confirm your email address, and lasts 7 days.
- Subscription: full access continues straight after PayFast confirms your payment, normally within a few minutes. If it hasn't appeared within one hour, email support@fruitspan.com.
- How you receive it: by logging in at fruitspan.com in a web browser, or from your phone, where you can also add Fruitspan to your home screen. You need your own internet connection and a current browser.
- Updates: new data is normally added once a week, after the source statistics are published. Timing can vary with the source.
- Downloads and reports are delivered instantly in your browser, as files you can save.
- Availability: we aim to keep the service available at all times, but it may be briefly unavailable for maintenance or for reasons outside our control. If the service is unavailable for more than three consecutive days in a month you have paid for, email us and we will extend your subscription by the time lost.
4. Price and payment
- There are two plans, both including VAT: monthly at R550 per month, or annual at R5 000 per year, paid in advance. There are no other charges from us.
- Team plan: one monthly subscription for several named people, each with their own login, priced per seat: R550 per seat per month for 2 to 4 seats, and R350 per seat per month for 5 seats or more, including VAT. The person who subscribes (the team owner) pays, invites colleagues by email and can add or remove seats; a changed number of seats is charged from the next billing date. Each seat is for one person and the device limit applies to every seat.
- Payments are taken in South African rand by PayFast, a registered payment service provider. Prices shown in US dollars or euros are guides only, at the day's exchange rate. If you pay in another currency, the conversion is done by PayFast or your bank, and any exchange-rate difference or bank fee is not charged by us.
- The monthly plan renews automatically every month on the same date until you cancel. The annual plan renews automatically every year on the same date until you cancel. If you subscribe during a free trial, nothing is charged until the trial ends.
- Annual renewal notice: between 40 and 80 business days before your annual plan ends, we email you the renewal date, the price, and your options to renew, change to monthly or cancel.
- Changing plan: you can switch from monthly to annual on the subscribe page. Your monthly payments stop, and the first annual payment is taken when your paid month ends. To move from annual to monthly, cancel the annual plan and choose monthly when it ends.
- Your card details are entered on PayFast's secure payment page and never reach us. PayFast's payment pages are protected by encryption and industry card-security standards.
- Before you pay, PayFast shows you the amount and lets you review, correct or cancel the payment. PayFast emails you a receipt for every payment, and your account page shows your subscription status.
- If a monthly payment fails, PayFast will try again. Your access continues for 3 days while this happens. If payment still isn't received, access stops until the subscription is renewed.
- We may change the price with at least 30 days' written notice by email. The new price only applies from your first payment after the notice period, and you may cancel before then.
5. Cancellation policy
- You can cancel at any time on your account page (Cancel subscription). There is no minimum period and no cancellation fee. You can also ask us to cancel by emailing support@fruitspan.com.
- Monthly plan: when you cancel, no further payments are taken. You keep access until the end of the month you have already paid for.
- Annual plan: you may cancel at any time, on 20 business days' notice, as the Consumer Protection Act allows. Your access continues for those 20 business days (or until the end of your paid year, if sooner). Whole months left in your paid year after that are refunded. The account page shows the exact end date and refund before you confirm.
- Team plan: the team owner can cancel as for the monthly plan; every team member keeps access until the end of the paid month. The owner can remove a member at any time, which ends that member's access straight away. A member can leave the team on their account page.
- If you cancel during a free trial, nothing is charged.
- We may suspend or cancel an account that breaks these terms, for example by sharing logins or redistributing data. Where reasonable, we will warn you first. If we cancel for a reason other than a breach by you, we refund the unused part of the month.
6. Refund policy
- Cooling-off period: if you are a consumer as defined in the Electronic Communications and Transactions Act, you may cancel within 7 days of your first paid subscription payment, without giving a reason, and we will refund that payment in full. We apply this to every new subscriber, whether or not the Act applies to you.
- Monthly plan, after the first 7 days: a month that has started is not refunded, because the service is delivered immediately and continuously. When you cancel, you keep access until the end of that month.
- Annual plan, after the first 7 days: unused whole months are refunded at one twelfth of the annual price each, as described under Cancellation.
- Charged in error: if you were charged incorrectly, for example twice, or after cancelling, email us within 60 days of the payment and we will refund the incorrect amount in full.
- Service not delivered: if you paid but could not access the service because of a fault on our side, we will refund or extend your subscription, as you prefer.
- How refunds are paid: to the card or account you paid with, through PayFast, within 30 days of your request. Any refund amount is in rand; exchange-rate differences on foreign cards are outside our control.
- To request a refund, email support@fruitspan.com from your account's email address, with the payment date.
Nothing in these terms limits the rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act, where they apply to you.
Referral programme
- Every account has a personal invite link. People who sign up with it get a 14-day free trial, if their email address hasn't had a trial before.
- When someone you invited has paid for a subscription and is still subscribed more than 7 days after their first payment, you earn a free month. If you pay through PayFast, one month's monthly fee is refunded to your card within 30 days; otherwise 30 days are added to your access.
- You can't invite yourself, including with another address for the same inbox. We may withhold rewards that appear to be earned unfairly, and may change or end the programme with notice; rewards already earned are honoured.
7. How you may use the data
Your subscription is for your own business or personal use. You may use the figures in your own work and share occasional extracts within your organisation. You may not resell, republish or redistribute the data, make it available to people outside your organisation, use it to build a competing product, or download it automatically or in bulk beyond normal use of the dashboard. Fruitspan's dashboard, design, analysis and content belong to us or our licensors.
8. Limitation of liability
To the extent allowed by law, we are not liable for losses arising from decisions made using the service, from errors in source data, or for indirect or consequential losses. Our total liability to you is limited to the amount you paid us in the three months before the claim. This does not limit liability that cannot legally be limited, including under the Consumer Protection Act, or liability for gross negligence or fraud.
9. Privacy
We handle your personal information under the Protection of Personal Information Act, as described in our privacy policy.
10. Complaints and disputes
- Email support@fruitspan.com. We will acknowledge your complaint within 2 business days and aim to resolve it within 10 business days.
- If you are not satisfied, consumers may refer the matter to the Consumer Goods and Services Ombud (cgso.org.za), or to the National Consumer Commission.
- Payment disputes can also be raised with PayFast or your bank.
11. General
These terms are governed by the law of the Republic of South Africa. Subject to your rights to use the dispute routes above, you and we agree to the jurisdiction of the South African courts, including the Magistrates' Courts. We may update these terms; we will email subscribers about material changes at least 30 days before they apply. If any part of these terms is found to be unenforceable, the rest still applies.
